2. (a) The entrance fee of €57.00 per annum (pro rata for members Joining after the commencement date) will be deducted in advance from members shares or as defined from time to time by the Board and will be credited to a special Car Draw Account in the Credit Union or

(b) An entrance fee of €5.00 per month commencing on the 30' h April 2005 and subsequently on the last day of each month will be deducted in advance from member's shares or as defined from time to time by the Board and will be credited to a special Car Draw Account in the Credit Union.

3. A member will be ineligible to enter the Draw if there are insufficient funds in their Account. Where this arises, the member concerned will he deleted from the draw Notwithstanding the draw, the minimum share account balance far full membership of the Credit Union is €6.00.

4. The make and type of car will be at the sole discretion of the Board. Cash will not be given in lieu, save in the implementation. of condition 16 below.

5. The Board, Staff and Volunteers of New Ross Credit Union Limited will not be liable for any defects, mechanical or otherwise, that may be found in any vehicle supplied. Cars supplied will be subject to the normal warranty issued by the manufacturers.

6. Participation in the Draw is strictly limited to eligible members of New Ross Credit Union Limited who are eighteen (18) years of age or over on or before the Draw date.

7. The winning member will be notified in writing and their name and photograph published in the local press.

8. All draws will be held publicly in the offices of New Ross Credit Union Limited or alternatively in a venue that may from time to time be determined by the Board, under the supervision of at least one Supervisor, one Director of the Board and one Member chosen at random.

9. Entry is limited to one person per account.

10. A register of entrants will be maintained at the Credit Union offices.

11. Application and Authorisation Forms for membership of the Draw must be completed in full prior to participation and no entry is valid unless full fees are paid and credited in advance.

12. Eligible members can participate in the draw only if written authorisation is received at commencement stage or subsequently at the
beginning of each year (i.e. April) or any time the Board may deem appropriate.

13. Financial Accounts of the Draw Fund will be audited each year and presented to the A.G.M.

14. The Draw must be self-financing and non- profit making and any surplus funds will be disposed of by way of extra draws.

15. The Board reserves the right to alter prizes in the event of any unforeseen circuanstances.

16. In the event that the winning member is in arrears or in default in carrying out any commitment or obligation to New Ross Credit Union Ltd., the Board may withhold delivery of the ear won by the member until the arrears have been paid or the default has been rectified to the satisfaction of the Board. Such decision of the Board will be notified in writing to the member, and if within 14 days of the member receiving such notification,

he/she has failed to comply with the requirements of the Board in relation to such arrears or default. the Board may sell or otherwise dispose of the car at the best available price (which will not necessarily be the list or garage selling price of the car), and pay to the -winning member the net proceeds after deducting any such arrears or paying any monies required to remedy anv defaults.

Notice of any Board decision shall be made by delivering it personally to the member or by posting it to him/her by registered post - in which
case the date of receipt will be deemed to be two working days after the date of pasting.

17. Entry implies acceptance of these rules as being final and legally binding. New Ross Credit Union Limited reserves the right to refuse the entry of, or award of prize to, anyone in breach of these Rules. Non payment of loans and arrears may result in the removal from the Members Monthly Car Draw.

18. The decision of the Board concerning the foregoing rules or any matter arising from the monthly Draw will be final and not subject to appeal.
